Terms of Service — Callyndar

1. Acceptance of Terms

By accessing or using the Callyndar platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Callyndar provides a multi-tenant SaaS reservation management system including:

A web-based dashboard for managing reservations, staff, and restaurant settings.
An embeddable booking widget for websites and hosted booking pages.
Guest and analytics data management tools.
Optional white-label and reseller capabilities on qualifying plans.

3. Account Registration

You must create an account to use the Service. You agree to:

Provide accurate and complete registration information.
Maintain the security of your account credentials.
Notify us immediately of any unauthorized account access.
Take responsibility for all activity that occurs under your account.

You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

4. Subscriptions and Billing

Access to paid features requires a subscription. When you subscribe, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

All fees are exclusive of taxes unless otherwise stated. We may change pricing with 30 days' notice. You can cancel your subscription at any time through the billing portal.

5. Acceptable Use Policy

You agree not to:

Use the Service for any unlawful purpose or to promote illegal activities.
Attempt to gain unauthorized access to our systems or other users' accounts.
Interfere with or disrupt the Service or its infrastructure.
Scrape, harvest, or systematically extract data from the Service.
Reverse engineer, decompile, or disassemble any part of the Service.
Use the Service to transmit spam, malware, or fraudulent content.

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms. Privacy Policy

As a restaurant operator, you are the data controller for guest booking data collected through your booking widget. Callyndar acts as a data processor on your behalf.

You are responsible for ensuring your guests are informed about how their data is collected and used, including providing appropriate privacy notices.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Callyndar B.V. and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all data you submit to the Service. You grant us a limited license to use, store, and process your data solely to provide the Service.

8. Termination

You may terminate your account at any time through the dashboard settings. Any prepaid fees for the current billing period are non-refundable.

We may suspend or terminate your account if you violate these Terms, with or without notice depending on severity.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days unless required by law to retain it.

Data export options are available for 30 days after account closure.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Callyndar B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes shall be submitted to the competent courts in Amsterdam, the Netherlands.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
